A practical way to check a temporary dental permit before agreeing to a clinical start date.

Can you work before dental Approbation? Potentially, yes: a dental Berufserlaubnis can authorise temporary dental practice. It is not automatic after BDS, a job offer or a language examination. The authority must grant it, and your actual permit determines the permitted work. Professional licensing and immigration permission are separate checks.
This guide is for Indian-trained dentists considering work while their full licensing pathway continues. It is not a medical-doctor Berufserlaubnis guide or a nursing recognition guide. 01 · Berufserlaubnis and Approbation are not interchangeable
Section 13 of the German Dentistry Act, the Zahnheilkundegesetz or ZHG, provides for temporary permission on application by people who demonstrate completed dental training. It permits restrictions to particular activities and employment locations. The ordinary statutory ceiling is a total of two years of dental activity under this permission within Germany; the law also contains exceptional extension provisions. Do not plan around an exception as though it were routine.
Official basis: ZHG §13: temporary dental practice permission. A two-year ceiling is not a promise that your individual permit will last two years.

A useful planning habit is to keep these documents in separate folders and compare them together. Do not use one document to answer a question that belongs to another. An attractive contract cannot tell you whether the licensing authority has authorised the proposed treatment duties.
02 · Read the permit, not the job title
The dental licensing regulation, ZApprO §122, requires the authority to consider training and relevant professional experience when assessing suitability for the intended work. It also addresses protective restrictions, language knowledge and health. An ongoing Approbation procedure does not itself prevent a temporary permission from being granted. None of this means that every applicant qualifies.
The same provision allows a permit shorter than two years and addresses territorial limitations. Accordingly, do not assume that changing the practice, duties or Land leaves your permission unchanged. Read the decision and obtain clarification before making the change. Read ZApprO §122.
Do not infer your clinical scope. The words “assistant dentist”, “supervised position” or “international dentist” in an advert do not substitute for permission. Turn the proposed job into a written description, then compare it with the authority’s conditions.
Use this permit-reading checklist:
- Identity: is the decision issued to you, with correct personal details?
- Dates: what are the effective date and expiry date?
- Location: which territory and employment location does it cover?
- Activities: are particular duties named, restricted or excluded?
- Conditions: what supervision or other arrangements are specified?
- Changes: who must clarify a proposed change before it happens?
For each point, copy the relevant wording into a working checklist and note any unanswered question. Keep the original decision intact. If a translation seems unclear, quote the German clause in your enquiry rather than asking the authority to respond to your paraphrase.
03 · Berlin: an example, not a Germany-wide checklist
Berlin’s official service page describes applying for the dental Berufserlaubnis alongside an Approbation application. It lists completed foreign dental training, health, reliability, German-language knowledge and evidence establishing Berlin’s responsibility. Applications may be made from abroad.
Its language requirements include B2 German and the C1-level dental specialist-language test through Zahnärztekammer Berlin. The page says language evidence need not already accompany the initial application. That distinction concerns submitting a file; it does not authorise clinical work while language requirements remain unmet.
Use the Berlin dental Berufserlaubnis service page as the starting point only if Berlin is your competent jurisdiction. It also provides the current forms and document details. Do not transfer its certificate rules or application arrangements to another Land.
At federal level, ZHG §16 connects responsibility for these decisions to the Land where the dental profession is intended to be practised, while allowing arrangements between Länder. Your practical first question is therefore: which authority is responsible for my proposed work location?
04 · Build an application file that answers questions clearly
The following is a preparation framework, not a substitute for the authority’s checklist. Start with the current dental-specific application instructions, not a medical-doctor document pack. Save the checklist with its retrieval date so that later requests can be compared with what you originally prepared.
- Establish jurisdiction. Record the intended Land, practice location and the authority’s requested evidence of responsibility.
- Separate qualification evidence. Organise your BDS award, training records and internship completion evidence so that the route to completed training is understandable.
- Organise professional history. Keep registration, employment and professional-status records identifiable, with dates that match your CV.
- Track language evidence. Record the certificate, examination body, result and any outstanding dental-language assessment.
- Plan time-sensitive documents. Check the current validity and submission rules before ordering health or conduct documents.
- Keep a submission log. Record what was sent, when, by which method and under which reference number.
India-specific preparation: compare the spelling of your name across your passport, university records, internship documents and dental registration. Make a separate note of discrepancies rather than silently changing scans or translations. If your university or council needs time to issue a document, include that dependency in your own plan.
For your working file, use a simple tracker with “document”, “issuing body”, “requested”, “received”, “translation or certification question” and “submitted”. This avoids repeatedly obtaining documents without checking whether they answer the authority’s actual request. Do not order an apostille, fresh translation or replacement certificate solely because a different candidate needed one.

05 · Ask the employer for a role you can actually check
Before accepting a proposed clinical start, ask for a written description of the workplace and responsibilities. This is practical due diligence, not a claim that every employer uses the same onboarding process. A conversation becomes much more useful when both sides are discussing the same role.
A concrete Berlin distinction: for work in statutory-insurance dental practice, KZV Berlin distinguishes an assistant with a Berufserlaubnis from a Vorbereitungsassistent. Its guidance says the latter role is not permitted for holders of a §13 permit in Berlin; the permit-holder assistant role requires supervision and prior KZV approval of the employment. Ask the practice to resolve the correct category and approval before starting. This is a Berlin-specific example, not a universal job-title rule. Official source: KZV Berlin assistant guidance.
Suggested questions for the practice:
- Which legal employer and practice address will appear in the contract?
- What duties are planned initially, and which are not?
- Who is the clinical contact for questions about my permit conditions?
- How would any required supervision be organised during actual working hours?
- What happens to the proposed start date if permission is not issued in time?
- How will changes in location, duties or licensing status be handled?
- What time arrangements should we discuss for language or licensing commitments?
Keep the employer’s answers with your permit checklist. Where the employer’s expectations and your authorisation do not match, identify the specific mismatch. “The practice says it is fine” is not a useful substitute for clarifying an ambiguous restriction with the issuing authority.

06 · Use a three-check start-date decision
Check one: professional permission. Is the licence issued and valid, and does its wording cover the proposed work? A pending application belongs in the “not yet confirmed” column of your plan.
Check two: immigration permission. Section 4a of the Residence Act requires residence titles to show whether employment is permitted and whether restrictions apply. It also addresses changes to employment restrictions. Do not assume that a dental licence settles your residence or employment conditions. Official source: AufenthG §4a.
Check three: employer readiness. Can the practice implement the role and conditions you have checked? Agree who handles outstanding administrative questions and when to reassess the proposed start. This third check is a planning recommendation, not another statutory licence.
For an unclear permit clause, a concise enquiry is better than a general request for reassurance. Suggested wording to adapt:
My reference number is [reference]. My permit states [exact clause]. The proposed position is at [practice and address], with [specific duties]. Please confirm whether this arrangement is covered or whether I must obtain an amendment before starting. The employer contact for clarification is [contact].
Replace every placeholder and ask only questions relevant to your file. Send immigration questions to the competent immigration authority rather than expecting the dental licensing office to answer for it. Keep dated responses together so that the employer receives the current position, not an earlier assumption.
07 · Common mistakes to avoid
- Copying a doctor’s route: check that every form and authority instruction concerns dentistry.
- Treating BDS as automatic eligibility: provide evidence of completed training and let the authority assess the application.
- Booking around an assumed approval date: use a conditional plan until the outstanding decisions are clear.
- Reading “up to two years” as guaranteed: plan from the actual permit dates, not the maximum.
- Changing employers first and asking later: clarify the effect on both professional and immigration permissions beforehand.
- Letting full licensing preparation stop: keep Approbation requirements and correspondence on a separate active tracker.
None of these planning checks predicts your outcome. Their purpose is to replace vague reassurance with specific documents, questions and responsibilities. You should be able to explain your current status accurately to an employer without overstating what has already been approved.
08 · Frequently asked questions
Can an Indian BDS dentist work without full Approbation?
A granted dental Berufserlaubnis can provide a temporary route within its conditions. BDS, an employer offer or an application receipt alone does not provide that permission. Check your professional and immigration documents together.
Is the dental Berufserlaubnis always valid for two years?
No. The ordinary statutory maximum is not a guaranteed individual duration. Read your permit’s dates and restrictions, and ask the authority about any proposed continuation before expiry.
Can I use the same permit in another German state?
Do not assume so. Review territorial and workplace conditions with the issuing authority before accepting work elsewhere. A new contract does not answer the licensing question.
Does Berlin require German before the permit is granted?
Berlin lists B2 German and a dental C1-level specialist-language test. Being allowed to submit language evidence later in the application process is not permission to work without meeting the requirements.
Does a Berufserlaubnis replace dental Approbation?
No. Treat it as temporary permission and maintain your full licensing plan separately. An ongoing Approbation application and the temporary-permission assessment address different decisions.
