INDIAN BDS • FIRST DENTAL JOB IN GERMANY

Before you sign: understand the role, not just the salary

A practical dental employment contract checklist for Indian BDS dentists, with questions to resolve before accepting a German practice or clinic offer.

Direct answer: Before signing, check the legal employer, permitted dental role, start conditions, guaranteed gross pay, hours, overtime, leave, probation, notice, insurance and repayment clauses. Compare the actual contract with your dental licence or permit and immigration work conditions. A job offer does not itself authorise dental treatment. Separate what the law requires from what this employer promises.

This guide is for Indian BDS graduates reviewing a first German dental employment offer, including candidates still completing recognition. It is not an MBBS hospital contract guide or individual legal advice. Start with the BDS-to-Germany dentist pathway if you are still deciding which professional route applies.

01. Identify the employer, role and permission to start

Write down the employer's complete legal name, workplace address and contact person. Ask whether the named entity is the practice owner, an operating company or another organisation. Check every proposed workplace, particularly if the contract allows movement between branches. Keep the recruiter separate from the employer: ask who pays you, directs your work and signs the contract.

Section 1 of the Zahnheilkundegesetz establishes the dental licensing framework. Under section 13, a temporary dental permit can restrict activities and employment locations. Therefore, compare the offered duties and address with the actual permission, not with an informal job title. For recognition planning, use our dental Approbation guide.

Ask for a precise description of treatment duties, supervision arrangements, documentation responsibilities and the person available when you need clinical advice. If you have a permit, send its conditions to the employer through an appropriate private channel. If permission is pending, ask how the contract handles delayed approval and what must happen before the clinical start date.

Immigration permission is a separate check. Section 4a of the Residence Act addresses employment permission and restrictions. Do not assume a dental licence removes a restriction in your residence documentation, or that a visa authorises dental practice. Resolve any mismatch with the competent authority before starting.

Practical question: “Which documents and approvals must be available before my first clinical working day, and who will confirm that the proposed duties match them?” Request a clear answer rather than a general assurance that everything will be arranged.

02. Build a contract review sheet

Section 2 of the Nachweisgesetz identifies essential employment terms to document, including employer and employee details, start date, workplace, duties, pay, working time, leave and termination arrangements. It also addresses references to applicable collective agreements. Its current text permits electronic transmission in text form under specified conditions, with exceptions and rights to a signed paper record. Do not rely on older summaries saying every employment document must always be paper-only.

For your review, gather the contract, referenced policies, remuneration annex and any separate training or relocation agreement. Mark unanswered points before signing. The following is a planning worksheet, not a model contract or a ruling on whether a clause is valid.

Contract areaQuestion to resolve
Role and locationWhat duties and branches are included?
Start and durationWhat happens if permission arrives late?
Pay and hoursWhat is guaranteed, and for which weekly hours?
Overtime and leaveHow are extra hours recorded and leave counted?
Insurance and supportWhat cover and practical support are confirmed?
Exit and repaymentWhat notice, restrictions or repayment demands apply?

03. Separate guaranteed pay from variable income

Ask the employer to identify the guaranteed monthly gross salary and its corresponding weekly hours. List bonuses, allowances, overtime arrangements and any revenue-linked component separately. Request the payment date and an explanation of each possible deduction. Compare offers using the same hours and guaranteed-pay basis, rather than comparing headline figures.

For a revenue-linked offer, request an illustrative calculation prepared by the employer. Ask what counts as eligible revenue, which costs are deducted, when revenue is attributed to you, and how corrections are handled. Ask what happens during onboarding, leave and quieter periods. Do not build your personal budget around a best-case bonus that has not been explained.

If a collective agreement is mentioned, request its exact name, current version and the clause making it applicable. Ask which pay category and experience level the employer proposes. Do not import an Assistenzarzt hospital salary table into a dental practice offer simply because both involve healthcare employment.

Read the working-time arrangement as carefully as the pay clause

Request a sample working week: patient appointments, documentation, meetings, breaks and any evening or weekend arrangements. Ask how working time is recorded, who approves overtime and whether compensation is money or time off. Clarify whether preparation and follow-up tasks are included in the stated schedule.

Section 3 ArbZG sets the general eight-hour working-day rule, allowing extension to ten hours when the statutory averaging condition is met. Section 4 sets break requirements. These are legal safeguards, not promises that your individual roster will have a particular shape.

Section 5 ArbZG generally provides eleven uninterrupted hours of rest, with specified exceptions and compensation rules. If an employer relies on an exception, ask which provision applies. Do not interpret an overtime clause as unlimited permission to extend every working day.

04. Check leave, probation and the exit route

Read the leave entitlement together with the number of working days per week. Section 3 BUrlG expresses the statutory minimum as 24 working days on a six-day-week basis. Do not compare that number directly with an offer expressed for a different weekly pattern. Ask the employer to show the entitlement for your actual schedule.

Ask about approval procedures, practice closure periods and how examination dates would be handled. Put a request for planned Dental FSP or KP attendance on the discussion list early. Do not assume ordinary annual leave and paid examination leave are the same benefit.

Probation, or Probezeit, is not simply a label. Section 622 BGB provides a two-week notice period during an agreed probationary period for up to six months. It also contains general notice rules and permits collective-agreement variations. Read the actual clause instead of assuming all contracts use identical periods.

For fixed-term employment, section 15 TzBfG matters: a calendar-based term ends at the agreed time, and ordinary termination requires provision in the individual contract or applicable collective agreement. An agreed probation period must be proportionate to the expected term and work. Ask specifically whether you can ordinarily terminate before the end date.

Under section 623 BGB, termination by notice and termination agreements require written form; electronic form is excluded. Do not assume an email or WhatsApp resignation completes that requirement. Obtain individual employment-law advice for an exit dispute, restrictive clause or unclear deadline.

05. Clarify insurance and recognition support

Request written confirmation of professional liability arrangements: who is insured, which activities and locations are covered, and whether there are exclusions or deductibles. Ask the insurer or a qualified adviser about any gap between the practice policy and your personal position.

The BZÄK commentary on general professional duties specifically discusses adequate personal liability cover for employed dentists. Its model professional code is a recommendation for Land chambers, not a substitute for checking the binding local code. This is why “the practice has insurance” is not a complete answer.

Break recognition support into concrete commitments: document coordination, named mentoring contact, exam scheduling flexibility, course costs or accommodation. Ask who pays each expense, whether payment is direct or reimbursement, and what evidence is needed. Keep employer support distinct from a licensing decision; our dental Berufserlaubnis guide explains the permission boundary.

If training, recruitment or relocation assistance comes with repayment terms, request the complete agreement before accepting. Identify the amount, triggering events, time period and calculation method. Ask what happens if approval is delayed or the employer ends employment. Have substantial or unclear obligations reviewed independently; this checklist cannot decide enforceability.

06. Use an India-specific signing sequence

  1. Create one comparison folder. Keep the offer, contract version, job description and annexes together. Label your Indian qualification, German recognition stage and permission status accurately.
  2. Read the German wording. Use translation to understand the document, but identify which version governs. Ask a qualified adviser about unclear legal language.
  3. Separate organisations. List the employer, recruiter, licensing authority and immigration office. Direct each question to the party that can actually answer it.
  4. Resolve promises in writing. Request an updated contract or appropriate annex when an important interview promise is missing.
  5. Coordinate travel and joining. Ask how a delayed clinical start affects salary, housing and travel arrangements before committing to non-refundable bookings.

Before the final conversation, prepare three columns: what the advertisement promised, what the contract says, and what still needs confirmation. Include practical items such as the named onboarding contact, access to clinical software training and arrangements for asking treatment questions. This makes the discussion specific without turning it into a confrontation.

Keep a copy of the exact version you sign and all agreed annexes. If a revised document arrives, compare it with the earlier version rather than checking only the clause you requested. Ask for time to read it properly and note any unresolved point for your adviser.

A useful employer message is: “Thank you for the offer. Before signing, could you confirm the permitted role and workplace, guaranteed gross salary, weekly hours, overtime arrangements, insurance cover and conditions for starting? Please also send the referenced policies and any repayment agreement.” Adapt this to the points genuinely missing from your documents.

07. Common mistakes and better decisions

  • Signing only the salary page: read all annexes and referenced obligations.
  • Equating an offer with permission: check dental and immigration conditions separately.
  • Trusting verbal support promises: request specific deliverables and responsibilities.
  • Ignoring the exit terms: understand notice and repayment before joining.
  • Using the wrong profession's template: keep BDS dental employment separate from MBBS residency and nursing recognition.

Use a simple decision record: resolved, clarification requested, or specialist advice needed. Attach the answer to each question. An attractive offer may still need clarification; a long contract is not automatically a bad offer. The goal is an informed decision with fewer assumptions.

08. Frequently asked questions

Can I accept an offer while dental recognition is pending?

Discuss a conditional start with the employer, but separate signing from treating patients. Actual clinical work requires the applicable dental permission and compatible immigration work conditions. Have the contract's start mechanism checked if approval is uncertain.

Does “assistant dentist” tell me what I may do?

No. Compare the written duties with your licence or permit and any restrictions. Ask the employer to clarify the exact role. A title is not a replacement for permission issued under dental law.

Is every probation period six months?

Do not assume so. Read the agreement. Section 622 BGB addresses notice during agreed probation, while section 15 TzBfG adds proportionality for fixed-term contracts. The precise arrangement needs checking against the applicable framework.

Should I sign a repayment clause for employer support?

First request the full amount, triggers and calculation. Consider the commitment alongside the benefit offered, and seek independent legal advice where significant money or restrictions are involved. There is no universal answer for every clause.

Who should answer licensing and contract questions?

Use the competent licensing authority for permission, the relevant dental chamber for professional-rule enquiries, and a qualified employment-law adviser for individual contract interpretation. The BZÄK guidance for foreign dentists provides authority and chamber signposts.
